MP High Court: Rape victim refuses to have abortion after hearing about danger to her life

MP High Court: The Madhya Pradesh High Court has allowed a minor rape victim to carry her eight-month pregnancy to term. The victim and her parents had refused to have an abortion when they realised that it could endanger the lives of both the child and the victim.

Jabalpur. In compliance with the previous directive, a medical report was presented before the single bench of Justice Amit Seth of Madhya Pradesh High Court. The expert doctors informed that abortion at the age of eight months can be dangerous for the child and the victim. On hearing this, the minor and her parents refused to have an abortion.

Considering the circumstances, the High Court allowed the victim to continue the pregnancy. In fact, under the High Court’s guideline of February 20, 2025, if a minor rape victim is more than 24 weeks (about six months) pregnant, then guidance will have to be taken from the High Court for abortion. This order was given to all the responsible departments.
